Who decides that I am mentally incapable of making decisions about health treatment?Health practitioners cannot treat you without your consent. If they decide that you are incapable of making decisions about your treatment, then they must get the consent of your substitute decision-maker.This means your attorney or other substitute decision-maker cannot make treatment decisions for you unless a health practitioner first decides that you are incapable of making them yourself.
